Former mobile phone store employee must repay almost $8,000

A former employee of a mobile phone store who stole almost $8,000 from the business may have avoided jail time, but was ordered by a judge to pay the money back.

Raymond Joseph Mahoney was sentenced in provincial court in St. John’s Thursday.

 

Raymond Joseph Mahoney pleaded guilty to theft over $5,000 and two counts of fraud. He was given a five-month conditional sentence, with a year’s probation, Thursday in provincial court in St. John’s.

The sentence, imposed by Judge Mark Linehan, also includes a restitution order for Mahoney to repay $7,743.72, which he took from the Wirelesswave kiosk in the Avalon Mall.

The 30-year-old took most of the money when he left the company in June 2012.

Using his employee user identification code to access company financial records, Mahoney completed refunds totalling $2,322.73 with a debit card.

It was also discovered that he stole various mobile phones and tablets, with a total value of $5,421.

Video surveillance taken from the Avalon Mall showed Mahoney going to the kiosk after hours.

When questioned by police, he admitted he had completed the fraudulent transactions. There were several other transactions made which police could not link to Mahoney.

In recommending a sentence, Crown prosecutor Jeff Summers said a four- to six-month prison term was appropriate for Mahoney, whose criminal record included theft and fraud charges from 2006.

Defence lawyer Colin Sheppard suggested a four-month conditional sentence, pointing out that Mahoney was deemed a low risk to reoffend in his pre-sentence report and has taken full responsibility for what he did. He added that Mahoney also battled a cocaine addiction and is getting help, with the aim of turning his life around.

“I want you to know I’m very regretful,” Mahoney said when given the chance to address the court. “I’m on the path to leading a positive lifestyle. Again, I’m very sorry.”
